These Terms and
Conditions of Use govern the use of this website. Please read them carefully. By
accessing any of its pages, you agree to be bound by these Terms and Conditions
of Use.
This website has been
established by BankSouth for the sole purpose of conveying information about
our products and services. Nothing
contained in any page of this site takes the place of the bank’s agreements and
disclosures that govern its products and services. If any information on the site conflicts with
that in the bank’s agreements and disclosures, the agreements and disclosures
will control.
The information and
materials contained in this website are owned by BankSouth or by others, as
applicable. No material may be copied,
displayed, transmitted, distributed, framed, sold, stored for use, downloaded,
or otherwise reproduced except as permitted by law.
If you are an
existing Internet Banking client of BankSouth, click Login in the upper right
corner of the website, and enter your username and password to access your
account(s). If you wish to enroll in
Internet Banking, you must maintain at least one account with BankSouth, which
may include the following types of accounts: checking account, savings account,
Money Market account, Certificate of Deposit, or a loan. To enroll, click Enroll
in the upper right corner of the website.
The Internet banking service requires that you complete the initial
application process providing the information needed to enable the service. During
the enrollment process, you will select a unique “Username” and “Password” that
will be used to gain access to the system.
We will verify the information you submitted for accuracy and
authorizations. We will notify you of the approval status or of account
activation by e-mail, in person, or by phone. Upon initial log-on to the
Internet banking service, you will be required to select a verification phrase
and answer five security questions. Additional security measures are required
for Cash Management clients.
BankSouth makes no
warranties of any kind regarding the products and services advertised on this
site. The Bank will use reasonable
efforts to ensure that all information displayed is accurate; however, the Bank
expressly disclaims any representation and warranty, express and implied,
including, without limitation, warranties of merchantability, fitness for a
particular purpose, suitability, and the ability to use the site without
contraction a computer virus. The Bank
is not responsible for any loss, damage, expense, or penalty (either in tort,
contract, or otherwise), including direct, indirect, consequential, and
incidental damages, that result from the access of or use of this site. This limitation includes, but is not limited
to the omission of information, the failure of equipment, the delay or
inability to receive or transmit information, the delay or inability to print
information, the transmission of any computer virus, or the transmission of any
other malicious or disabling code or procedure. This limitation applies even if
the Bank has been informed of the possibility of such a loss or damage.
The Terms and Conditions
of Use may be changed from time to time by posting new Terms and Conditions of
Use on the website. All users agree to
be subject to this agreement as it changes from time to time.
These Terms and
Conditions of Use are subject to the provisions of all applicable operating
circulars of the Federal Reserve System and any other applicable provisions of
Federal law. Except as so provided,
these Terms and the use of this Site are governed by and interpreted in
accordance with the laws of the State of Alabama. These Terms shall be binding and upon and
inure to the benefit of the parties hereto and their respective legal
representatives, successors, and assigns.
